How does the origin of descent of the surviving spouse and other cousins affect the division when a spouse, uterine brother, and another cousin exist?
General Chapter
Al-Mughni
Book of Inheritance Shares (Farā'id)
Primary text
If the surviving spouse is a paternal cousin descended from both parents (min Abawayn), the entire remainder after fixed shares goes to him. If the spouse and the third cousin are both descended from both parents, the remaining third is divided between them. This resolves to six parts: two-thirds for the spouse, and one-sixth for each of the other two heirs.

Ibn Mas'ud consistently allocates the remainder after the spouse's prescribed share to the heir who is a uterine brother in all these cases.
