What is the ruling concerning *Manasikhat* (Successive Inheritance Cases)?
Chapter on the Roots of Inheritance Shares that Increase (Awl)
Al-Mughni
Book of Inheritance Shares (Farā'id)
Primary text
Manasikhat concerns the death of one of the initial heirs before the division of the first deceased person's estate. The approach depends on whether the heirs of the first deceased inherit the second deceased in the same proportion as they inherited from the first, such as when they are all *Asaba* (agnates) to both, or when this alignment occurs in a few specific cases involving Sharers (*Ashab al-Furud*). If the inheritance proportions align perfectly, the distribution is calculated solely based on the heirs of the second deceased, disregarding the first estate division.
Supporting text
If an heir of the first deceased inherits from the first but not from the second (e.g., a wife who is not the mother of the second heir's relatives), her specific share from the first estate is set aside, and the remainder is distributed according to the second distribution rules. If the heir who died second had no inheritors other than those who also inherited from the first, the entire inheritance is divided among the survivors based on the second distribution rules, ignoring the portion due to the deceased second heir, as it has already accrued to them.
