What is the ruling if a husband secluded himself with his wife (khulwah) before consummation and stated, 'I will not touch her,' and she believed him?
Chapter on Distant Kindred (Dhawu al-Arham)
Al-Mughni
Book of Inheritance Shares (Farā'id)
Primary text
If seclusion (khulwah) occurs, and the husband makes such a declaration and the wife believes him, she is entitled to inheritance, must observe the waiting period prescribed for death (idda al-wafah), and is entitled to the full dower. This is because seclusion is considered sufficient to establish these rulings.
