Does a sane minor engaging in intercourse with the husband's prohibited kin (e.g., wife's daughter or mother) dissolve the marriage?
Chapter on Distant Kindred (Dhawu al-Arham)
Al-Mughni
Book of Inheritance Shares (Farā'id)
Primary text
If the actor is a sane minor, the wife inherits because the minor possesses a sound intention. Abu Hanifa considers this case equivalent to an insane person because the minor's statement holds no weight.
Supporting text
Regarding the Shafi'i view on a minor engaging in intercourse with the wife's daughter or mother, there are two opinions: one holds that the wife's marriage is not dissolved because the act does not render the relative permanently forbidden (Muharram). The second opinion is that the wife is separated from him, and neither inherits from the other.
