Is an increase in value of a purchased slave due to pregnancy, occurring before the seller rescinds the sale due to the buyer's bankruptcy, considered an attached or detached increase?
General Chapter
Al-Mughni
Book of the Insolvent (Bankruptcy)
Primary text
If a slave purchased by someone who subsequently becomes bankrupt is pregnant, and the value increases due to this pregnancy, this increase is considered an attached increase that prevents the original seller from revoking the sale entirely, according to the opinion of Al-Khiraqi. The evidence for such rulings is derived from the principles established regarding attached and detached increases in contracts.
