Can a seller who is lawful reclaim game in the possession of a bankrupt buyer who is in a state of Ihram?
General Chapter
Al-Mughni
Book of the Insolvent (Bankruptcy)
Primary text
If the person in bankruptcy is in Ihram and possesses game whose seller was lawful (not in Ihram), the lawful seller has the right to take back the game. This is because the impediment (the seller being in Ihram at the time of sale, or the game being hunted illegally) is not present in this specific case concerning the seller's right to reclaim.
