If the buyer and the captive disagree on the price paid for the captive's ransom when the buyer acted on the captive's behalf without permission, whose statement is accepted?
General Chapter
Al-Mughni
Book of Jihad
Primary text
If the buyer and the captive disagree on the amount the buyer paid for the captive's ransom, the statement of the captive is accepted. This is because the captive is denying the excess amount, and the statement of the denier is accepted. Furthermore, the default position is the acquittal of his liability from this excess, thus favoring his statement based on the original state of innocence.
Supporting text
Al-Awza'i held that the statement of the buyer should be accepted because the disagreement pertains to an action where the buyer has more knowledge of his own deed.
