What is the permissible action for Muslims on a ship set on fire by non-believers?
General Chapter
Al-Mughni
Book of Jihad
Primary text
When non-believers set fire to a ship carrying Muslims, resulting in danger, the obligation is to choose the action where safety is most likely, whether remaining on the burning vessel or throwing oneself into the water. If both options appear equally likely to lead to death, Imam Ahmad permits the individual to choose as they wish. Al-Awza'i considered both outcomes as two deaths and advised choosing the less severe of the two.
Supporting text
Abu al-Khattab narrated a differing opinion stating that remaining on the ship is obligatory because abandoning it results in death by one's own action, whereas staying means death results from the action of others.
