The safe conduct of a non-Muslim, even a Dhimi (protected person), is invalid because the Prophet (PBUH) designated the covenant as belonging to the Muslims ("The covenant of the Muslims is one"), meaning it cannot be obtained by others. Furthermore, he is suspected of acting against Islam and its adherents, resembling a hostile combatant.
