Is a share of the spoils of war (*ghanimah*) due to those left behind by the commander in enemy territory?

A share is due to those whom the commander left behind in the enemy's land, provided they remained there until the commander returned, because the commander appointed them. If the commander explicitly exempted the weak and they sought refuge in a safe haven (*ma'man*) where Muslims already were, remaining there until the army departed means no share is due to them. However, if they remained in a place of fear while waiting, a share is due. If they were left behind and remained in the enemy's country until the army returned, they receive a share. If they returned to their own safe territory, they receive nothing. If a man was left behind due to illness or a lame mount, and the commander instructed him to remain for a share or to return home for a share, this second option (returning home for a share) is disapproved because one who returns home is not treated the same as one left behind in enemy territory.
