The slayer of an unbeliever is entitled to the spoils. There is no known disagreement on this point. The foundation for this ruling is the statement of the Prophet, peace be upon him: "Whoever kills a disbeliever is entitled to his spoils." This was narrated by a group, including Anas and Samurah ibn Jundub. Evidence further supports this through the narration of Abu Qatadah concerning the Battle of Hunayn, where the Prophet, peace be upon him, confirmed that the one who kills a person has the right to their spoils, and he upheld this ruling even when another person claimed the spoils belonged to him until the rightful slayer provided testimony.
