Spoils entitlement for a minor boy (sabi)?
General Chapter
Al-Mughni
Book of Jihad
Primary text
The minor boy is given a consolation gift and not a full share. This is the view of Al-Thawri, Al-Layth, Abu Hanifa, Al-Shafi'i, and Abu Thawr. This is because he is not qualified for fighting, similar to a slave. Furthermore, it is not authentically narrated that the Prophet (peace be upon him) assigned shares to boys, as he generally did not permit them to participate in fighting until they reached the age of fifteen.
Supporting text
Malik states that a boy who fights and is capable receives a share, as he is a free, capable fighter. Al-Awza'i also states he receives a share, citing the Prophet (peace be upon him) sharing spoils with boys at Khaybar. Some scholars suggest the consolation gift given to boys was termed a 'share' in narration.
