Must the statement of the captive regarding being granted safety be accepted even if the Muslim affirms the captive's claim?
General Chapter
Al-Mughni
Book of Jihad
Primary text
The statement of the captive regarding being granted safety is not accepted, even if the Muslim corroborates it. This is because the Muslim lacks the authority to effectively grant safety, and therefore his admission of having granted it is not accepted. However, if the captive's status as an enemy combatant is not established and no one disputes his claim, his statement regarding the granting of safety is accepted, similar to the ruling concerning a messenger.

The Shafi'i scholars maintain that the captive's testimony is not accepted, even if the Muslim confirms it, due to the Muslim's lack of authority to guarantee safety and thus his admission concerning it is invalid.
