Muslims are permitted to lodge in the churches and synagogues. 'Umar made a treaty with the people of Sham requiring them to widen the doors of their synagogues and churches for passing Muslims so they could enter while riding. If they do not find space there, they may stay in the courtyards and unused parts of the houses, but they are not allowed to displace the owner. The one who arrives first to a dwelling has precedence over those who come later. If some of them refuse to fulfill what was stipulated, they are compelled. If all refuse, they are compelled, and if compulsion requires fighting, they are fought, and in fighting, they have broken the covenant.
