Is an offering made by a woman when she is not obligated to pay the Jizya accepted?
General Chapter
Al-Mughni
Book of Jizya
Primary text
If a woman offers to pay the Jizya, or states, 'I will donate it' or 'I will render it,' it is accepted from her. This accepted payment is not considered Jizya, but rather a gift (*hibah*) that becomes binding upon acceptance. If she stipulates payment upon herself and then retracts, she is permitted to do so, even if she initially offered the Jizya in order to reach the abode of Islam. She is permitted entry without payment, provided she commits to abiding by the rulings of Islam, thus establishing the covenant of protection (*dhimma*). However, if anything is taken from her other than a voluntary offering made after she knew she was exempt, it must be returned to her. This is because she paid it under the belief that it was obligatory upon her and that her life would not be protected without it, similar to someone paying money to one whom they believe is owed the money, only to find out the recipient has no right to it.
