What is the prescribed amount of *Jizyah* if it is considered fixed?
General Chapter
Al-Mughni
Book of Jizya
Primary text
If the *Jizyah* is considered fixed, the amount is established as forty-eight Dirhams for the wealthy, twenty-four Dirhams for the middle class, and twelve Dirhams for the poor, which is the position of Abu Hanifa. Al-Shafi'i holds that the obligatory amount is one Dinar for everyone, based on the Hadith concerning Mu'adh, although he recommends structuring it in three tiers to avoid contention. The established practice of 'Umar, which was followed by subsequent Caliphs without objection, proves that the tiered system is preferable and represents consensus.

Malik holds that the amount is forty Dirhams or four Dinars for the wealthy and ten Dirhams or one Dinar for the poor, a view attributed to 'Umar. Al-Shafi'i justifies the potential discrepancy in the Hadith of Mu'adh by suggesting it was due to the extreme poverty of the people of Yemen or that the valuation was left to the Imam's discretion. Furthermore, *Jizyah* is viewed as a humiliation or punishment, which naturally varies based on circumstances, unlike rent for residence, which would apply equally to women, children, and the infirm.
