If the defendant refuses the oath but states they have evidence to present or an account to verify so that they may swear with certainty regarding what they know, the court must postpone the ruling (*ta’khīr al-ḥukūma*). If the defendant simply states they do not wish to swear, their right concerning the oath is forfeited in that session.
