Must a deposed judge be summoned without evidence if accused of unjust killing of the claimant's son?

If the claim against the deposed judge is that he unjustly killed the claimant's son, there are two opinions regarding whether he must be summoned without prior evidence. If summoned and he confesses, judgment is passed against him.

If the judge denies the accusation, his word is accepted.
