Must the judge include his name in the address or the body of the letter?
General Chapter
Al-Mughni
Book of Judiciary
Primary text
It is not required for the judge to mention his name in the heading (*unwan*) nor to mention the name of the recipient in the body of the document. This is the opinion of Al-Shafi'i.
Supporting text
Abu Hanifa requires that the judge's name be mentioned in the body; otherwise, the communication is rejected because it is not directed to him specifically. Furthermore, mentioning the name only in the heading without the body is insufficient because it does not constitute a proper form of direct address (*mukhatabah*).
