Is the testimony of the one performing the partition (Qasim) accepted regarding the partition?
General Chapter
Al-Mughni
Book of Judiciary
Primary text
The testimony of the Qasim regarding the partition is accepted if he acts voluntarily (mutatatti') without pay. If he receives a fee, his testimony is rejected because he becomes suspected of self-interest, as his testimony secures the fee for himself. This is the view held by Al-Istakhri.
Supporting text
Abu Hanifa accepts the testimony even if compensated, arguing no suspicion attaches, similar to a wet nurse. Al-Shafi'i rejects it, asserting that one cannot testify to an act that establishes their own integrity/qualification, similar to a dismissed judge testifying about his own ruling.
