To whom is the consideration paid in the Khul' of a slave?
General Chapter
Al-Mughni
Book of Khul' (Redemption Divorce)
Primary text
When a slave effects Khul', the consideration belongs entirely to his master because it is derived from his labor, and his labor belongs to his master. This principle applies to all others mentioned who effect Khul' and receive consideration.
Supporting text
The consideration due upon the slave's Khul' must be delivered to his master, and the consideration due upon the Khul' of a person under guardianship (Mahjur 'alayh) must be delivered to their guardian, because the consideration in the slave's Khul' is the property of the master, and it is impermissible to deliver it to anyone else without the owner's permission. The guardian is the one who receives the rights and properties of the ward. The consideration in the Khul' of the Mahjur 'alayh belongs to him, but it cannot be delivered to him because the guardianship prevents him from transacting.
