Is it permissible for a wife to seek separation (Khul') from her husband?
General Chapter
Al-Mughni
Book of Khul' (Redemption Divorce)
Primary text
It is permissible for a woman to seek separation from her husband if she dislikes him due to his character, disposition, religion, old age, weakness, or similar reasons, and she fears she cannot fulfill her obligations to Allah in obedience to him. She may do so in exchange for compensation to redeem herself. This is supported by the verse: Quran 2:229. Furthermore, the Prophet Muhammad (peace be upon him) ruled in the case of the wife of Thabit ibn Qays, where she was granted divorce upon returning the garden (Hadiqah) given to her by her husband, as stated in authentic narrations recorded by Imams Malik and Ahmad, and in Al-Bukhari. The consensus of the jurists of Hijaz and Sham affirms this ruling.
Supporting text
The compensation taken is termed 'Khul'' because the woman is shedding the marital garment, referenced by Quran 2:187, and 'Iftida' (redemption) because she redeems herself with wealth, referenced by Quran 2:229.
