What is the required compensation if a valid Khul' is established without specifying the amount?
General Chapter
Al-Mughni
Book of Khul' (Redemption Divorce)
Primary text
If the Khul' is valid, *mahr al-mithl* is not obligatory because the wife did not offer it, nor did she cause the loss of something that mandates it. The release of intimacy from the husband's domain is not valued monetarily, evidenced by cases where the marriage is nullified due to her apostasy or the nursing of a child (rida'ah), where no compensation is due to the husband. If she kills herself or is killed by a third party, the husband receives no compensation for her intimacy. The intimacy is only valued monetarily within the marriage contract itself, and permission is given for her to ransom herself due to her need. Therefore, the obligatory amount is what she consented to offer; imposing something she did not agree to has no basis.

If the Khul' is conditioned upon the dirhams currently in her possession, it is valid; if she possesses dirhams, they are his. If she possesses nothing, three dirhams are due from her. This minimum amount (three dirhams) is stipulated by Ahmad because it is the lowest amount that can technically be called dirhams, and her language implies this specific amount when nothing is present, establishing his right to it as if he were bequeathed dirhams.
