What is the ruling if the husband grants unrestricted authorization (itlaq) for Khul'?
General Chapter
Al-Mughni
Book of Khul' (Redemption Divorce)
Primary text
Unrestricted authorization implies Khul' should be conducted using the wife's dower amount (mahr) specified to her, payable immediately, and in the currency of the locality. If the agent concludes the Khul' for this amount or more, it is valid, as adding to the compensation benefits the husband. If the agent concludes it for less, the ruling follows the two differing views mentioned previously concerning the agent accepting less than specified compensation.

Al-Qadi mentioned two other possibilities: one where the specified dower is dropped and the fair dower (mahr al-mithl) becomes obligatory, as the agent acted without authorization; and another where the husband has the option to accept the lesser compensation without the right of revocation, or reject it and retain the right of revocation (rujū').
