What is the ruling when a husband states, 'You are divorced three times for one thousand,' and the wife replies, 'I accept one of them for one thousand'?
General Chapter
Al-Mughni
Book of Khul' (Redemption Divorce)
Primary text
The pronouncement of three divorces takes effect, and the wife is liable to pay the one thousand. This is because the husband tied the issuance of the divorce to a consideration (compensation) acting as a condition originating from her side, and the condition has been met, thus the divorce occurs.
Supporting text
If she replies, 'I accept for two thousand,' the divorce occurs, but the additional thousand is not incumbent upon her because acceptance only obligates what it specifically agreed upon. If she replies, 'I accept for five hundred,' the divorce does not occur because the condition (one thousand) was not met. If she replies, 'I accept one of the three for a third of the one thousand,' it does not occur because he did not consent to the cessation of his right to revoke the divorce except for the full amount of one thousand.
