What is the ruling when a husband tells his wife, 'Your affair is in your hand if you guarantee me one thousand'?
General Chapter
Al-Mughni
Book of Khul' (Redemption Divorce)
Primary text
The ruling, by analogy with the conditional divorce statement, is that the delegation of authority (*amruk bi-yadik*) is conditional upon deferral (*ala al-tarrakhi*). Therefore, when she guarantees the thousand, her affair is in her hand, and the husband retains the right to revoke the delegation, as one may revoke a power of agency (*tawkil*). This contrasts with the Shafi'i position, which holds the delegation to be immediate.
Supporting text
The basis for the deferral view is that if a husband says to his slave, 'If you guarantee me a thousand, you are free,' it is on deferral. Likewise, 'You are free upon one thousand if you will,' is on deferral. Since divorce is analogous to manumission (*itq*), the deferral applies here.
