Book of Khul' (Redemption Divorce)

Book 38 · Issue 3 · Bab 1

Open in Qurani

Primary text

If the wife offers consideration for separation, it is definitively a divorce, with no scholarly disagreement. This applies even if the wording used is not explicit divorce language, such as the euphemisms for divorce (*kinayat al-talaq*), or words like Khul' or *Mufadah*, provided the husband intended divorce by it. In this case, since a euphemism intended to mean divorce was used, it results in a divorce, similar to separation without consideration.

Supporting text

If the husband did not intend divorce when utilizing the euphemism or Khul' wording offered by the wife, this is the scenario where the two differing narrations regarding whether Khul' constitutes a divorce or a Faskh apply.
