Is a craftsman liable for damage to an item held to secure payment of wages?
General Chapter
Al-Mughni
Book of Leasing
Primary text
The craftsman who detains a garment after completing his work, pending the full payment of his wages, is liable for its loss. This liability arises because the owner did not pledge the item to him, nor did he authorize the craftsman to retain possession of it. Therefore, the craftsman is obligated to guarantee its safety, similar to a usurper (ghasib).
