What is the ruling regarding the ownership and disposal of the thread used by a tailor in an unauthorized alteration when the thread belongs to the tailor?
General Chapter
Al-Mughni
Book of Leasing
Primary text
If the tailor used his own threads to stitch up the garment after cutting it into an unauthorized form, he has the right to remove those threads because they are his own chattel. He is not obligated to accept compensation for them, as removing them does not cause damage to an object deserving sanctity. Agreement between the parties for compensation is permissible as it concerns their mutual rights.
Supporting text
If the owner of the cloth claims he will reattach his own threads to every stitch removed by the tailor such that the original thread returns to its place upon removal, the tailor is not required to comply, as this constitutes using the tailor's property for the owner's benefit.
