If the item is damaged while in the possession of the second user, the liability rests solely and definitively upon the second user in all cases, because they took possession under the condition that it would be a guaranteed item in their hands. If the original owner seeks recovery from the original borrower, the original borrower may then seek recourse against the second user. If the original owner seeks recovery directly from the second user, the second user has no recourse against anyone else.
