What is the ruling regarding land lent for cultivation?
General Chapter
Al-Mughni
Book of Loan for Use
Primary text
The lender may revoke the loan of land for cultivation until planting commences. Once planted, the lender cannot revoke the loan until the crop matures. If the borrower offers the value of the crop for the lender to take ownership, it is not permitted to the lender, as the crop has a determined time limit until its end. If the crop can be harvested immediately (like fodder/qaseel), the lender may revoke at the time harvest is possible due to the absence of harm.
Supporting text
If the crop is not immediately harvestable, the lender cannot revoke until the crop matures. If the lender permitted building or planting, the lender may revoke before the removal of the structure or planting, but if the borrower has planted and built, the lender may revoke the use of the land between the planted/built structures, as the borrower's ownership has not attached to the land itself, and no harm results from revocation there.
