Is the finder of lost property entitled to the reward if the offer only mentions finding it, not returning it?
General Chapter
Al-Mughni
Book of Lost-and-Found Property
Primary text
If the offeror states, 'Whoever finds my lost property shall have one dinar,' the finder is indeed entitled to the reward because they have fulfilled the stated condition of finding (al-wujudan).
Supporting text
The context and customary understanding imply that the intent behind the offer is the complete return of the item. The mention of mere finding is sufficient because finding is the necessary prerequisite and cause leading to the return, making the statement equivalent to saying, 'Whoever finds my lost property and returns it to me.'
