What is the obligation if the finder consumes or sells an item that spoils quickly?
General Chapter
Al-Mughni
Book of Lost-and-Found Property
Primary text
If the finder decides to consume the item or sell it, they must preserve its characteristics and announce its finding for one year. If the owner appears, and the item was sold, the preserved price must be returned. If the item was consumed, or the price was consumed, the finder must compensate the owner with its value on the day it was consumed. If the item spoils, decreases in value, or the price is lost without negligence (tafrit) before ownership is established, the finder is not liable. If spoilage or loss occurs due to the finder's negligence, the finder is liable. Likewise, if the price is lost or decreases after the finder has taken ownership, the finder is liable for it.
