Primary text

Delaying the declaration of found property beyond the first full year, when timely declaration was possible, constitutes a sin. This is because the Prophet (PBUH) commanded it within that period, and command implies obligation. Evidence supporting this includes the statement, 'Do not hide it, nor let it disappear,' found in the narration of Iyadh ibn Himar. Furthermore, delaying prevents the owner from knowing it, as it is presumed that after a year, the owner will give up hope, forget, and cease searching. However, according to a narration attributed to Ahmad, the obligation of declaration lapses if delayed past the first year because the wisdom behind the declaration cannot be achieved after that period.

An alternative view suggests that the obligation to declare does not lapse due to delay, as it is an obligation similar to worship or other duties that are not voided by late performance. Therefore, even if delayed into the second year, the declaration must still be made because the objective is still somewhat achieved, based on the Prophet's statement, 'When I command you with a matter, then fulfill of it what you are able to do.'
