What is the duration for which a divorced woman claiming pregnancy must be supported?
General Chapter
Al-Mughni
Book of Maintenance (Nafaqāt)
Primary text
Support must be provided to the divorced woman for three months. After this period, female examiners (qawabil) should assess the pregnancy. If pregnancy is confirmed, support continues. If her freedom from pregnancy is established through menstruation or other means, support ceases immediately, similar to the finding of non-pregnancy by the examiners. In the case where support was paid but pregnancy was disproved, the husband recovers what he spent, as she unjustly took what was not her due, analogous to a false debt claim.

There is an alternative opinion attributed to Ahmad stating that the husband does not recover the support paid, as it was paid under the ruling derived from the vestiges of the marriage, similar to support in a void marriage after its invalidity is established.
