What are the entitlements (residence and maintenance) for a woman who has undergone Mula'anah (mutual imprecation)?
Chapter on the Condition in which Maintenance is Obligatory on the Husband
Al-Mughni
Book of Maintenance (Nafaqāt)
Primary text
If a woman who has undergone Mula'anah is not pregnant, she has neither residence (sokna) nor maintenance (nafaqah). This applies equally if she is pregnant but her pregnancy is negated, or if her paternity is negated, whether by the husband's denial or by the separation of the bed (*zawal al-firash*). However, if paternity is not negated by the denial, and the child's lineage is attached to the husband, then she is entitled to both residence and maintenance because these relate to the pregnancy, which is currently present. In this scenario, she is analogous to a woman in a revocable divorce (*talqah ba'in*).
Supporting text
If the husband denies the pregnancy, and the mother provides maintenance, residence, and nursing for the child, and subsequently the imprecating husband acknowledges paternity, the lineage is established, and the obligations of maintenance, housing costs, and nursing fees become due from him. This is because the mother acted upon the assumption that the child had no father; once a father is established, these obligations revert to him.
