Primary text

A dwelling is obligatory upon the husband, evidenced by the saying of Allah: {Settle them where you dwell, according to your means} (Quran 65:6). If lodging is obligatory for a divorced woman, it is more so for one currently in a valid marriage, supported by Allah’s command: {And live with them in kindness} (Quran 4:19), as providing a dwelling is part of kindness. Furthermore, the wife requires a dwelling for concealment from eyes, for domestic activity, enjoyment, and the safekeeping of property. The dwelling must be proportionate to their affluence or hardship, based on the decree {according to your means} (Quran 65:6). Since it is an obligation for her benefit in perpetuity, it follows the ruling of sustenance and clothing.
