The maintenance for a wife is obligatory based upon the Book (Quran), the Sunnah, and scholarly consensus. The evidence from the Book is found in the verse stating that the one with means must spend from his means, and the one whose provision is straitened must spend from what Allah has given him (Quran 34:7, 13:26 mentioned as context). Further evidence is derived from the verse concerning what Allah has ordained for the wives (Quran 33:50). From the Sunnah, the Prophet's instruction in the farewell sermon emphasizes the duty of husbands to provide their wives with sustenance and clothing in a fair manner (as narrated by Muslim, Abu Dawud, and Tirmidhi). The authenticated narration concerning Hind demonstrates that a wife is entitled to take what suffices her and her children by recognized standard (Ma'ruf) if the husband is miserly (Agreed upon narration). Consensus (Ijma) exists among the scholars regarding the obligation of maintenance upon husbands for their wives, provided the wife is not defiant (Nashiz), with this obligation being justified by the wife being confined to the husband, preventing her from earning a living.
