If the minor husband possesses wealth and his guardian refuses to spend on maintenance, the judge shall compel the guardian through imprisonment. If he still refuses, the judge seizes the minor's wealth to cover the maintenance costs. If seizure is impossible and the guardian endures imprisonment while maintenance remains unpaid, the judge may decree divorce between them upon the wife's request, consistent with rulings concerning the adult husband.

The view of Al-Qadi states that divorce should not be decreed here, just as in the adult case, because both situations—the adult and the minor husband who cannot provide maintenance—are equal regarding the obligation of maintenance, and thus should be equal in their resulting rulings.
