There are two differing narrations regarding a pregnant widow. The first narration grants her housing and maintenance because she is pregnant by her deceased husband, similar to a woman divorced during the husband's lifetime. The second narration denies her housing and maintenance. This latter view holds that since the estate has passed to the heirs, and the maintenance and housing for the pregnant woman are for the fetus or because of it, it is not incumbent upon the heirs. If the deceased had an inheritance, the maintenance for the fetus would be from his share; if the deceased left no inheritance, the heirs are not obligated to spend on the pregnant wife's fetus, just as they are not obligated after childbirth. The view denying housing and maintenance is considered more correct.
