When is a wife deprived of maintenance due to refusal of access?
Chapter on the Condition in which Maintenance is Obligatory on the Husband
Al-Mughni
Book of Maintenance (Nafaqāt)
Primary text
A wife is not entitled to maintenance if she refuses access to her husband, if her guardians prevent the access, or if both parties remain silent after the contract without offering or requesting access for a period. Evidence for this is found in the practice concerning the Prophet, peace be upon him, who did not provide maintenance for Aisha until after consummation, even though the marriage contract preceded it by two years. Maintenance is due in exchange for the access stipulated by the marriage contract; if that access is withheld, maintenance is forfeited.

If the wife offers incomplete submission, such as agreeing to be with him only within her house or a specific location, she is not entitled to maintenance unless this limitation was stipulated in the marriage contract, as this is not the complete surrender required by the contract.
