What is the disposition of Wala' if co-owners manumit the slave after the first manumission but before compensation is paid?
General Chapter
Al-Mughni
Book of Manumission
Primary text
If the co-partners manumit the slave after the first emancipation and before the value is paid, no manumission takes effect for them, nor does the Wala' accrue to them. The entire Wala' belongs to the first emancipator, who remains liable for the value. This is because the slave became free immediately upon the first emancipator's act of manumission.
Supporting text
According to Malik, the Wala' is shared among the partners in proportion to their shares, and the first emancipator owes nothing for the compensation.
