What is the ruling when an owner of half of two equal slaves emancipates one of them while healthy and owning nothing else?
General Chapter
Al-Mughni
Book of Manumission
Primary text
If a man owns half of two slaves equal in value and emancipates one of them while in good health, that slave is freed, and the emancipation extends to his partner's half. This extension occurs because the owner is wealthy (*mu'sir*) with the half share he holds in the other slave. If he then emancipates the remaining half share in the other slave, that too is validly freed because the obligation to pay the value (*qimah*) upon his person does not invalidate his act of emancipation; however, it does not extend further because he is now insolvent (*mu'sir* regarding further obligation).
