Chapter on What is Prohibited to Marry and Combining Between Them and Other Matters
Al-Mughni
Book of Marriage
Primary text
If the man admitted to solvency before consummation and the master verified this admission, no dower (*mahr*) is due.
Supporting text
If the master denies the admission, the husband owes half of the stipulated dower, as he is claiming the validity of the marriage and the initial presumption is in his favor. If the admission occurred after consummation, the entire stipulated dower is due, unless the value of the dower of the like (*mahr al-mithl*) is greater. According to the opinion obligating *mahr al-mithl* in an invalid marriage, the greater *mahr al-mithl* becomes due due to his admission.
