Is freedom from physical defects necessary for suitability?
General Chapter
Al-Mughni
Book of Marriage
Primary text
Freedom from defects (like leprosy or insanity) is not a condition for the validity of suitability. If such a defect is absent, the marriage is not voided, but it grants the woman the right of dissolution (Khiyar). A guardian may prevent her from marrying someone afflicted with leprosy, advanced syphilis (Abraṣ), or insanity, but other defects are not considered within the scope of Kafa'ah for dissolution by the guardian.
