What happens if a man divorces all his wives before their waiting periods expire, and some subsequently embrace Islam?
Chapter on Marriage of Polytheists
Al-Mughni
Book of Marriage
Primary text
If he divorces all and then some embrace Islam within their waiting period while others do not, the marital bond is established only with those who embraced Islam. The divorce takes effect upon them. If the rest embrace Islam later, he may marry them because no divorce took effect upon them. The distinction from the previous case is that here, his divorce occurred when he lacked the right to elect (before their Islam), so the election right is renewed upon their conversion. In the prior case, he divorced them while having the election right, and since the divorce applied to all equally, lots (Qur'ah) were drawn to determine the four chosen ones, as their rights were equal.
Supporting text
If he divorces all, lots are drawn among them. If the lot falls upon four, they become the elected wives, and the divorce takes effect upon them, dissolving the marriage of the rest. If the divorce was three, once their waiting periods end, he may marry those who were not divorced, as they were not divorced from him. The divorced women are only lawful to him after another marriage and consummation.
