Primary text

The marriage of Zayd and Usama to Arabiyyatayn is used as evidence that the absence of equality (lack of Kafa'ah) does not invalidate a marriage contract. Imam Ahmad provided an excuse regarding their marriages by stating that Zayd and Usama were originally Arabs from the tribe of Kalb, and slavery (Riqq) was an incidental state that happened to them. Therefore, this ruling applies to anyone who is originally of Arab descent.
