Is it permissible for a free man to marry his son's female slave?

It is not permissible for a free man to marry his son's female slave because the father holds a semblance of ownership over the slave. This ruling is held by the people of Hijaz. The evidence for this prohibition is the statement of the Prophet (peace be upon him): 'You and your wealth belong to your father.' Furthermore, if a man owned a part of a female slave, his marriage to her would be invalid; therefore, that which is entirely ascribed to him by religious law is more deserving of prohibition.

The people of Iraq permit this marriage, asserting that the slave is not owned by the father directly, nor is she freed upon the father's emancipation of her.
