Marriage with the women of the Magians is unlawful. This is the position stated by Ahmad and held by the general body of scholars. The evidence for prohibition rests on the general Quranic injunctions: "Do not marry the polytheistic women" (Quran 2:221) and "Do not keep the bonds of marriage with disbelieving women" (Quran 60:10). A concession was made for the People of the Book (Jews and Christians), meaning all others remain under the general prohibition. Furthermore, it is not established that the Magians possess a divine book. Even if they did possess a book, the ruling of the People of the Book does not extend to others.

Abu Thawr permitted such marriage based on the Prophet's saying, "Treat them with the ruling applied to the People of the Book," and because they pay the Jizyah, thus resembling the Jews and Christians. Furthermore, a narration suggests that Hudhayfah married a Magian woman, though this narration is disputed, with alternative reports stating she was Jewish or Christian, and Ahmad considered the narration mentioning a Magian woman weak.
