What are the legal consequences of absolutely forbidden intercourse (Zina)?
Chapter on What is Prohibited to Marry and Combining Between Them and Other Matters
Al-Mughni
Book of Marriage
Primary text
Absolutely forbidden intercourse, which is Zina (adultery/fornication), establishes the prohibition of affinity, though this is subject to a difference of opinion previously mentioned. However, it does not establish the prohibition of being a mahram to the woman (mahramiyyah) nor does it permit looking upon her. The rationale is that if intercourse under suspicion does not establish these consequences, then the absolutely forbidden act certainly will not.
Supporting text
Zina does not establish paternity (nasab), nor does it require the imposition of the dower (mahr) if the woman consented willingly to the act.
